By accessing or using MySmartStudyPartner ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and MySmartStudyPartner. Your continued use of the Service following any modifications to these Terms constitutes acceptance of those modifications.

MySmartStudyPartner is an AI-powered personal study tool designed to help users organize their learning materials, create flashcards, take quizzes, manage study sessions, and interact with AI assistants for educational support.

MySmartStudyPartner is not an educational institution, accredited learning platform, or certified tutoring service. The Service is intended as a supplementary tool to assist with self-directed learning.

You must be at least 13 years of age to use MySmartStudyPartner. By using the Service, you represent and warrant that you meet this minimum age requirement.

Users Aged 13–17

If you are between 13 and 17 years of age, you must have the consent of a parent or legal guardian to use the Service. Your parent or guardian must review and agree to these Terms on your behalf.

COPPA Compliance

In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under the age of 13. If we discover that a child under 13 has provided us with personal information, we will promptly delete such information.

MySmartStudyPartner integrates with third-party AI services, including but not limited to:

• Anthropic (Claude)— for AI-powered study assistance, content summarization, and conversational tutoring.
• OpenAI APIs— for supplementary AI features including content generation and analysis.

Important Disclaimers

• AI-generated content is provided for informational and supplementary purposes only and should not be treated as authoritative or definitive.
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
• You are solely responsible for verifying any AI-generated content before relying on it for academic or any other purposes.
• AI features are supplementary tools and should not replace professional instruction, textbooks, or authoritative academic sources.

All user data in MySmartStudyPartner is stored locally in your browser's localStorage. This means:

• Your study notes, flashcards, quiz results, and preferences are saved exclusively on your device.
• There is no cloud backup or server-side storage of your personal study data.
• Clearing your browser data, switching browsers, or using a different device will result in loss of your data.
• You are solely responsible for backing up and preserving your data. The Service provides a data export feature in Settings for this purpose.

By using the Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to circumvent, disable, or otherwise interfere with any safety or security features of the Service.
• Use the AI features to generate content that is harmful, misleading, or violates the usage policies of our third-party AI providers.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service to facilitate academic dishonesty, plagiarism, or cheating. You are responsible for maintaining academic integrity in accordance with your educational institution's policies.

The content and features provided by MySmartStudyPartner are for informational and educational support purposes only.

• The Service is not a substitute for professional education, qualified instruction, or expert advice.
• MySmartStudyPartner does not grant, issue, or confer any academic credentials, certificates, degrees, or qualifications.
• All educational content is provided strictly for informational purposes and personal learning enrichment.
• Study progress, quiz scores, and performance metrics displayed within the Service are for personal tracking only and have no academic standing.

Your Content

You retain full ownership of all content you create within the Service, including notes, flashcards, and other study materials. Since all data is stored locally on your device, you maintain complete control over your content.

Our Property

The MySmartStudyPartner application, including its code, design, user interface, graphics, logos, and all associated intellectual property, is owned by MySmartStudyPartner and protected by applicable intellectual property laws. You may not copy, modify, or distribute any portion of the application without express written permission.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, MySmartStudyPartner shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Any academic outcomes, grades, test scores, or educational consequences resulting from the use of the Service.
• Loss of data due to browser data clearing, device issues, or any other circumstances.
• Inaccuracies, errors, or omissions in AI-generated content.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review our Privacy Policy to understand our data practices.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of these Terms and increment the version number.

Material changes will be communicated to you through an in-app notification, and you may be asked to review and accept the updated Terms before continuing to use the Service.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

You may stop using the Service at any time. To delete your data, navigate to the Settings page and use the "Delete All Data" option, which will permanently remove all locally stored information.
