MySmartStudyPartner ("we," "us," or "our") operates the MySmartStudyPartner application (the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Service.

This policy applies to all users of the Service, including minors who use the Service with parental or guardian consent. By using the Service, you agree to the collection and use of information in accordance with this policy.

The following types of information may be collected and stored locally on your device:

• Study Content— Notes, flashcards, and other learning materials you create within the Service.
• Quiz Scores & Results— Performance data from quizzes taken within the Service, including scores, answers, and completion dates.
• AI Chat Conversations— Messages exchanged with the AI assistant, including your questions and AI-generated responses.
• Study Session Data— Information about your focus sessions, including duration, subject, and timestamps.
• Preferences & Settings— Your chosen display name, study goals, theme preferences, and other configuration options.
• Date of Birth— Collected solely for age verification purposes to ensure compliance with age-related regulations.
• Parent/Guardian Email— Collected only for users aged 13–17, used exclusively for obtaining verifiable parental consent.

Your information is used for the following purposes:

• App Functionality— To provide core features such as note management, flashcard review, quizzes, study planning, and focus timer sessions.
• AI Processing— To send relevant content (such as note text or chat messages) to AI services for generating summaries, study aids, flashcards, quizzes, and conversational assistance.
• Personalizing Your Experience— To tailor the study experience based on your preferences, study patterns, and performance data.

We do NOT:

• Use your data for advertising purposes.
• Sell, rent, or trade your personal information to third parties.
• Use your data for any purpose other than providing and improving the Service.

MySmartStudyPartner integrates with the following third-party AI services to power its intelligent features:

Anthropic (Claude)

• Data sent: Note content, chat messages, and quiz content that you choose to process with AI features.
• Data handling:Processed in accordance with Anthropic's privacy policy and usage policies. Your data is not used to train their models.

OpenAI

• Data sent: Note content, chat messages, and quiz content that you choose to process with AI features.
• Data handling:Processed in accordance with OpenAI's privacy policy and API data usage policies. Your data is not used to train their models when accessed through the API.

You may opt out of AI data processing at any time through the Settings page. Disabling AI processing will deactivate AI-powered features such as content summarization, AI chat, flashcard generation, and quiz generation.

We are committed to protecting the privacy of children and comply with the Children's Online Privacy Protection Act (COPPA).

• We do not knowingly collect personal information from children under the age of 13. Users must be at least 13 years old to use the Service.
• For users aged 13–17, we require verifiable parental consent before allowing full access to the Service.
• Our parental consent mechanism requires a parent or guardian email for verification purposes.

Parent/Guardian Rights

Parents and guardians have the right to:

• Review the personal information collected from their child.
• Request deletion of their child's personal information.
• Refuse further collection or use of their child's information.
• Withdraw consent previously given by contacting us at privacy@studymindai.com.

MySmartStudyPartner is a personal study tool and is not an educational institution, school, or educational agency as defined under the Family Educational Rights and Privacy Act (FERPA).

• Data created within the Service does not constitute "education records" as defined by FERPA.
• The Service does not maintain institutional educational records and is not subject to FERPA requirements.
• Your study data is not disclosed to any educational institution unless you explicitly choose to share it.
• No data is disclosed to third parties without your explicit consent, except when processed by AI services that you have opted into.

For users in the European Economic Area (EEA), we process your data in compliance with the General Data Protection Regulation (GDPR).

Lawful Basis for Processing

We process your data based on your explicit consent, which you provide during the onboarding process and can manage at any time through the Settings page.

Data Minimization

We only collect and process data that is strictly necessary for the functionality of the Service. All data is stored locally on your device, minimizing data exposure.

Your Rights Under GDPR

You have the right to:

• Access— Request a copy of all personal data we hold about you.
• Rectification— Correct inaccurate or incomplete personal data.
• Erasure— Request deletion of all your personal data ("right to be forgotten").
• Data Portability— Export your data in a structured, machine-readable format.
• Withdraw Consent— Withdraw your consent for data processing at any time without affecting the lawfulness of prior processing.
• Object to Processing— Object to specific types of data processing.

To exercise any of these rights, visit the Settings page where you can view, export, and delete your data.

Your data is stored and secured as follows:

• localStorage Only— All personal study data is stored in your browser's localStorage. No personal data is stored on our servers.
• No Server Transmission— Your data is not transmitted to our servers. The only external data transmission occurs when you use AI features, where relevant content is sent to third-party AI APIs for processing.
• Browser Security Model— Your data is protected by your browser's same-origin policy, which prevents other websites from accessing your MySmartStudyPartner data.
• Device-Level Security— We recommend using device-level security measures (screen lock, encryption, strong passwords) to further protect your data, especially on shared devices.

Your data is retained according to the following principles:

• Data persists in your browser's localStorage until you explicitly delete it.
• There is no automatic expiration or scheduled deletion of your data.
• You can delete all data at any time through the Settings page using the "Delete All Data" option.
• Individual items (notes, flashcards, quiz results) can be deleted individually through their respective interfaces.

MySmartStudyPartner does not use cookies. Instead, we use browser localStorage for the following categories:

• Essential Storage— Required for core functionality including theme preferences, compliance state, and user preferences. This storage cannot be disabled as it is necessary for the Service to function.
• Analytics Storage— Used for tracking study session data, performance metrics, and learning progress. Optional and can be toggled in Settings.
• AI Processing Storage— Used for caching AI interactions and preferences. Optional and can be toggled in Settings.

You can manage your storage preferences at any time through the Settings page under "Data Storage Preferences."

When you use AI-powered features, your data may be processed by third-party AI services located in the United States or other countries.

By opting into AI features during onboarding or through the Settings page, you consent to the transfer of relevant data to these services for processing. No personal data is transferred internationally outside of AI API calls that you have explicitly consented to.

We may update this Privacy Policy from time to time. When we make changes:

• We will update the "Last updated" date and increment the version number at the top of this policy.
• Material changes will trigger a re-notification through the onboarding flow, requiring you to review and accept the updated policy before continuing to use the Service.
• We encourage you to review this policy periodically to stay informed about how we protect your information.
